Alternative Dispute Resolution

(i) Arbitration

What is arbitration?

Arbitration is a form of alternative dispute resolution (“ADR”). ADR is a mechanism for the resolution of disputes outside the court system. The parties to a dispute refer it to arbitration by one or more persons (the “arbitrator(s)”), and agree to be bound by the arbitration decision (the “award”). Arbitration is an alternative to court litigation that in many cases is mandatory by virtue of a provision in written contract.

The founding member of RM was selected to the prestigious position of committee member of the ADR committee of the Bar for the City of New York. RM has successfully arbitrated cases for years. (ii) Mediation

What is mediation?

Mediation, is a form of alternative dispute resolution (“ADR”). ADR is a mechanism for the resolution of disputes outside the court system. During a mediation, the mediator, a third party neutral, assists the parties to negotiate a settlement. Mediation may be used to facilitate the resolution of a dispute in all types of disputes ranging from commercial, legal, diplomatic, workplace, community and family matters. Mediation is an alternative to court litigation that in many cases is mandatory by virtue of a provision in written contract.

The founding member of RM was selected to the prestigious position of committee member of the ADR committee of the Bar for the City of New York. RM’s unique experience as a litigant in mediation and as a mediator, provides for a singular view of a dispute. We use this unique perspective along with a variety of tools and resources to evaluate the mediation and problem before recommending an appropriate approach for each individual client.

Appeals

What is an appeal?

At the conclusion of a case, either or both parties may consider appealing a part or the entire decision. Before an appeal is filed, the decision and record in the lower court must be analyzed.

Effective appellate advocacy requires a candid assessment of the strengths and weakness of the case and the costs associated with an appeal, to determine what is ultimately in the best interests RM conducts an analysis of lower court orders to assess the likelihood of success of an appeal, prepare an appellate budget for the case, and prepare an anticipated timeline for the resolution of the appeal.
